     Samuel's will written May 8, 1820 and probated August, 1821

In the name of God, amen. May the Eighth in the year of our Lord One Thousand Eight Hundred and Twenty. I Samuel Rosebrough of Rowan County and the state of North Carolina, being very low by affliction but in perfect mind and memory thanks be given to God, and calling to mind my mortality that it is appointed for man to die, I do make this my last will and testament, as touching such worldly estate wherewith it has pleased God to bless me within this life. I give, bequeath and dispose of in the following manner and form. Vis, my will and pleasure is that those just debts that I do owe to any person or persons be first paid and satisfied by my executors hereafter named.

Item. I give and bequeath unto my wife Elizabeth, the plantation whereon she now liveth with all my household and kitchen furniture of every description. Also my farming utensils, grain of all kinds, also all kinds of stock during her widowhood or natural life, for the support of my children. If the widow should marry, the land with all the household and kitchen furniture, farming tools, grain, stock and everything on the premises must be sold, equally divided between my wife and children, she drawing a child's part. Or, if she dies my widow, the land and property to be disposed of as above mentioned, to my children, to them, their wives and assigns forever.

Lastly, I name, ordain, constitute and appoint John Rosebrough and Elizabeth Rosebrough executors of this, my last will and testament, revoking and disannulling all others and former wills, ratifying and confirming this and no other to be my last will and testament.

Know all men by these Presents, that we William Price & John Maxwell are held and firmly bound unto Chs Fisher, Jacob Fisher & Jno McClelland Esquires. and the rest of the Justices assigned to keep the peace for Rowan County, in the just and full sum of two hundred & fifty Pounds current money of the said state to be paid to the said Chs Fisher, Jacob Fisher & Jno McClelland or their successors: To the which payment well and truly be made we bind ourselves, our heirs, executors and administrators, jointly and severally, firmly by these presents. Sealed with our seals, and dated this 16 day of Febry Anno domini 1824.

Wheras the above bounded William Price [Rosebrough?] hath been this day by the worshipful Court of said county, appointed guardian ("guardian underlined") to Margaret, Thomas, Sophronia, Samuel & Alise Rosebrough, orphan of Samuel Rosebrough deceased; Now the Condition of the above Obligation is such, ("Now the Condition of the above Obligation is such" underlined) that if the said William Rosebrough Guardian as aforesaid, shall well and truly discharge his said guardianship, by taking care of and improving all the estate belonging to the said orphan, and shall also settle his guardianship accounts with the Court of said county, as is required by law, and that he will deliver up to the said Margaret, Thomas, Sophronia, Samuel & Alse Rosebrough, orphan as aforesaid, when they shall attain lawful age, all such estate as they ought of right to be possessed of, or sooner if required, agreeably to the true intent and meaning of the act of the General Assembly in such case made and provided, then this obligation to be void; otherwise to remain in full force and virtue.

State of North Carolina, Rowan County, Pursuant to an order of Court 1 November 1833, We the undersigned, coming together with William Barber, Surveyor, have alloted and divided the lands of the estate of Samuel Rosebrough, deceased, in the following manner to wit:

Lot No. 1 to Polly (In the original document to the right of respective divisions exist a Rosebrough, containing drawing of the divisions, This drawing is included in our Larson 22.97 Acres - valued at source.) $90.-- and is to receive from No. 5 the sum of $10.--.

No. 2 Containing 26 1/2 Acres valued at $92.-- and is to receive from No. 5 the sum of $8.-- To Samuel Rosebrough

No. 3 Containing 31 1/2 Acres valued at $96.-- To Sophronia Rosebrough and is to receive from No. 5 the sum of $4.--.

No. 4 Containing 32 Acres, valued at $100.-- To Silas Phifer in the Right of Margaret Turner.

No. 5 Containing 32 Acres, valued at $122.-- To Benjamin Huie in Right of Thomas Rosebrough and he is to pay to No. 1 the sum of $10.--, To No. 2 the sum of $8.--and No.3 the sum of $4.--, The lots, bounds, courses and distances as represented by the above draught. - -
